CLASSIC & PRESTIGE AUTO SERVICES PTY LTD

PAYMENT & VEHICLE COLLECTION TERMS

PAYMENT

• Payment is required in full before vehicle release.

• Payment is due immediately upon completion of authorised work.

DEPOSITS – LARGE / LONG-TERM JOBS

• A 50% deposit may be required before work commences.

• Parts will not be ordered and work will not begin until the deposit is paid.

• Deposits are non-refundable once work has commenced or parts are ordered (except as required by law).

PROGRESS PAYMENTS

• For long-term jobs, progress invoices are issued approximately every 14 days.

• Work may be paused if progress payments are not received promptly.

VEHICLE COLLECTION & STORAGE

• Vehicles must be collected within 3 business days of completion notification.

• Storage fees of $22 per day apply after this period.

• Storage fees may also apply if work is delayed due to non-payment or lack of response.

LATE PAYMENT

• Overdue amounts may accrue interest at 12% per annum, calculated daily.

• Customers are responsible for reasonable recovery costs, including debt collection and legal fees.

MECHANIC’S LIEN – QUEENSLAND

• Vehicles may be retained until all outstanding amounts are paid in full.

• This includes repairs, parts, labour, storage fees, interest, and recovery costs.

UNCOLLECTED VEHICLES

• Vehicles not collected within 30 days may be dealt with under the Disposal of Uncollected Goods Act 1967

(Qld).

IMPORTANT: By leaving a vehicle with us, customers agree to these terms. Full terms are available on request.

WARRANTY & TERMS OF SERVICE

1. APPLICATION OF TERMS

These Warranty & Terms of Service apply to all mechanical repairs, servicing, diagnostics, and related work performed by Classic and Prestige Auto Services Pty. Ltd. (“we”, “us”, “our”).

By authorising work to be carried out, the customer (“you”) agrees to these terms.

2. AUSTRALIAN CONSUMER LAW

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

Nothing in these terms limits or excludes your rights under the ACL.

3. WORKMANSHIP WARRANTY

3.1 We warrant our workmanship for a period of twelve (12) months or 20,000 kilometres, whichever occurs first, from the date the work is completed.

3.2 This warranty applies only to defects arising directly from our workmanship.

3.3 This warranty does not extend to unrelated failures, wear and tear, or pre-existing conditions.

4. PARTS WARRANTY

4.1 Parts Supplied by Us

(a) Parts supplied by us are covered by the manufacturer’s warranty applicable to those parts.
(b) Where a part is accepted as defective under the manufacturer’s warranty:

  • The part itself may be replaced under that warranty

  • Labour for removal and refitting is not covered unless paid by the manufacturer
    (c) We will provide reasonable assistance in making warranty claims with manufacturers.

4.2 Customer-Supplied Parts

(a) No warranty is provided on customer-supplied parts.
(b) No warranty is provided on labour associated with the installation or failure of customer-supplied parts.

5. EXCLUSIONS

This warranty does not cover faults or damage caused by:

(a) Normal wear and tear
(b) Vehicle age or high kilometres
(c) Overheating, misuse, neglect, or abuse
(d) Competition use, racing, or towing beyond manufacturer limits (unless agreed in writing)
(e) Pre-existing conditions or failures in components not replaced during the repair
(f) Failure of ancillary or related components not replaced during the repair, including but not limited to sensors, hoses, cooling system components, and fuel system components
(g) Failure caused by lack of proper maintenance after repairs
(h) Work modified, repaired, or interfered with by another party

Diagnostic or inspection time is not covered unless the fault is confirmed to be directly related to defective workmanship.

6. ENGINE REBUILDS & MAJOR MECHANICAL REPAIRS

6.1 For engine rebuilds or major mechanical repairs, warranty coverage is conditional upon:

(a) Compliance with any run-in procedures provided
(b) Completion of any required post-repair inspections (for example, at approximately 1,000 km)
(c) Ongoing proper (documented) maintenance following the repair, namely oil change and filter replacements (using correct quality and specification parts) every 5000km or 6 months, (whichever comes first).

6.2 Due to the age, condition, and usage history of many engines, failure of ancillary or related components not replaced during the repair is not covered.

7. WARRANTY CLAIM PROCEDURE

7.1 Any warranty claim must be notified to us as soon as reasonably practicable.

7.2 The vehicle must be returned to our workshop for inspection.

7.3 We must be given a reasonable opportunity to inspect and, if applicable, rectify the issue.

7.4 No warranty repairs will be authorised without inspection by our workshop.

8. LIMITATION OF LIABILITY

8.1 If a warranty claim is accepted, our liability is limited to, at our discretion:

(a) Rectification of the defective workmanship; or
(b) Refund of the labour component directly relating to the defective workmanship.

8.2 To the extent permitted by law, we are not liable for towing, transport costs, loss of use, or consequential loss.

9. GOVERNING LAW

These terms are governed by the laws of Queensland, Australia.
